and conditions

By registering or using our Services, you agree to the following Terms and Conditions, which set out the Agreement between you (the “Candidate”) and hackajob Ltd. (“hackajob”, “we”, “us”, “our”). Please read these terms carefully. If you do not accept them, you must stop using our Platform and Services.

  1. Definitions and Interpretation 
    1. In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

      “Candidate”, “you” “your”

      means any person being an individual who registers for an account on the hackajob platform, including but not limited to those seeking permanent full-time employment, contingent work, or other forms of professional engagement. 

      “Employer”

      means any person, firm, or company including any associates or subsidiaries to whom the Candidate may be introduced via the Services with a view to the Employer hiring  the Candidate; 

      “Candidate Content”

      means any text, graphics, images, audio, video, software, data compilations, and any other form of information capable of being stored in a computer that is uploaded by a Candidate;

      “Code of Conduct”

      means hackajob’s rules of behavior relating to, courtesy, diversity, and inclusion which are available to view here.

      “Content”

      means any text, graphics, images, audio, video, software, or data compilations including, but not limited to, text, graphics, logos, icons, sound clips, video clips, data compilations, page layout, underlying code and software, and any other form of information capable of being stored in a computer that appears on, is uploaded to or forms part of the Services; BUT excluding Candidate Content;

      “Data Protection Legislation” 

      Data Protection Legislation means the General Data Protection Regulation (Regulation (EU) 2016/679) (“GDPR”); the Data Protection Act 2018; the retained European Union law version of the GDPR (the “UK GDPR”); the Data Protection Directive (95/46/EC); the Regulation of Investigatory Powers Act 2000; the Telecommunications (Lawful Business Practice) (Interception of Communications) Regulations 2000 (SI 2000/2699); the Electronic Communications Data Protection Directive (2002/58/EC); the Privacy and Electronic Communications (EC Directive) Regulations 2003 (SI 2426/2003); the California Consumer Privacy Act (CCPA); the California Privacy Rights Act (CPRA); any applicable federal or state privacy laws of the United States, including the Health Insurance Portability and Accountability Act (HIPAA) and the Gramm-Leach-Bliley Act (GLBA); the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 under the Information Technology Act, 2000; the Digital Personal Data Protection Act, 2023 of India; and all other applicable laws and regulations relating to the processing of personal data and privacy, whether now or in the future in force, including where applicable the guidance and codes of practice issued by relevant regulatory authorities, such as the Information Commissioner’s Office in the UK or equivalent bodies in other jurisdictions.

      “hackajob” “we”, “us”, “our”

      means hackajob Ltd. a limited company registered in England under company number 09279930 with its  registered registered office at 3rd Floor 1 Ashley Road, Altrincham, Cheshire, United Kingdom, WA14 2DT; and

      “personal data”

      means any information relating to an identified or identifiable individual, as defined under the UK GDPR, the General Data Protection Regulation (Regulation (EU) 2016/679) (“GDPR”), the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), and any applicable federal or state privacy laws of the United States, including the Health Insurance Portability and Accountability Act (HIPAA); and under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 of India..

      “Platform”

      means the hardware and software environment in which the software element of the Services operates, which comprises one or more server computers (whether virtual or not), mirroring/duplicating/back-up and storage systems and relative hardware operating software, virtual machine software (where relevant), operating system software, database software, antivirus and security software, switches, power supplies and telecommunications infrastructure;

      “Privacy Policy”

      means hackajob’s Privacy Policy which can be found here https://hackajob.com/talent/privacy-policy; 

      “Services”

      means the Candidate matching, and other services provided by hackajob to the Candidate

      “Terms and Conditions”

      means these Terms and Conditions as amended or supplemented at the relevant time;

      “Website”

      means this website www.hackajob.com website or such other URL as is intimated to you by hackajob from time to time;

    2. Unless the context otherwise requires, each reference in these Terms and Conditions to:
      1. “writing”, and any cognate expression, includes a reference to any communication effected by electronic transmission or similar means;
      2. a statute or a provision of a statute is a reference to that statute or provision as amended or re-enacted at the relevant time;
      3. a Clause or paragraph is a reference to a Clause of these Terms and Conditions; and
      4. a "Party" or the "Parties" refer to the parties to these Terms and Conditions.
    3. The headings used in these Terms and Conditions are for convenience only and shall have no effect upon the interpretation of these Terms and Conditions.
    4. Words imparting the singular number shall include the plural and vice versa.
    5. References to any gender shall include any other gender.
  2. The Contract
    1. You must be at least 18 years of age to use the Services.
    2. By registering or using hackajob, you confirm that you accept these Terms and our Privacy Policy and that you agree to comply with them.
    3. We recommend that you print a copy of these Terms and Conditions for future reference.
    4. Any and all business entered into by hackajob is subject to these Terms and Conditions and in the event of any conflict with any other Terms and Conditions, these terms shall prevail unless agreed otherwise in writing by a Director of hackajob.
    5. The Candidate shall be deemed to have accepted and agreed to be bound by these Terms and Conditions by clicking to accept them and a contract on these Terms and Conditions shall be deemed to come into existence at that time.
    6. These Terms and Conditions supersede all previous terms of business.
  3. The Services
    1. hackajob shall provide the Services to the Candidate at no cost to the Candidate. hackajob is engaged and paid byEmployers to match Candidates to permanent full-time and contingent vacancies.
    2. Whilst hackajob requires its Employers to ensure that all information that the Employers provide to it is complete, accurate, and up-to-date, hackajob does not undertake or guarantee that the vacancy advertisements and other information made available to the Candidate will be complete, accurate, or up-to-date.
    3. If hackajob lists a vacancy that the Candidate is offered by an Employer, which the candidate wishes to accept, the Candidate must carefully check the employment contract and any offer letter they receive from the Employer. The Candidate acknowledges and agrees that the terms and conditions contained in those documents will constitute their terms of employment, that those documents take precedence over other communications regarding their offer of employment, and that it is the Candidate’s sole responsibility to raise any queries or discrepancies with the Employer before accepting any employment contract/offer letter.
    4. Any contract the Candidate has with an Employer will be between the Candidate and that Employer. hackajob shall have no liability whatsoever to the Candidate with regard to any contract between the Candidate and the Employer. It is the Candidate’s responsibility to comply with the terms of each Employer’s contract. Failure to comply with an Employer’s contract may have financial and other consequences for a Candidate.
    5. Any dispute between a Candidate and an Employer will be determined in accordance with the contract between the Candidate and the Employer or in accordance with the Employer’s dispute resolution provisions or via the civil courts. hackajob shall not be involved in any such dispute.
    6. Introducing a Candidate to an Employer does not mean that hackajob makes any recommendation or endorsement of any particular Candidate or Employer or their products or services. hackajob provides no warranty as to the quality or standard of any Employer’s products or services and no guarantee is made by hackajob that such products or services will be fit for purpose.
    7. The Candidate hereby indemnifies hackajob and holds hackajob harmless against any claim, action, loss, or demand incurred by hackajob arising from the Candidate entering into a contract or contracts with an Employer.
  4. Candidate Information
    1. In order to use the Services, the Candidate will be asked to provide details and information which shall include, but not be limited to:
      1. their identity;
      2. contact information;
      3. date of birth;
      4. qualifications (including, but not limited to, any required by law or any relevant professional body);
      5. any necessary authorisations and permits;
      6. training, experience, and employment history;
      7. references;
      8. in certain circumstances, medical conditions, and disabilities;
      9. the Candidate’s confirmation that they are legally entitled to work in the location and vacant position to be filled, and, where required by hackajob, evidence of all the foregoing matters.
      10. hackajob requires such details in order to match the Candidate with the appropriate Employers and vacancies. If the required information is not provided, it is less likely that a successful match will be made.
    2. The Candidate must ensure that all information submitted to hackajob is, to the best of their knowledge, true, accurate, complete, and up-to-date.
    3. In the event that the information submitted to hackajob by the Candidate becomes incorrect, inaccurate, incomplete, or out-of-date, the Candidate must submit appropriately revised information to hackajob as soon as is reasonably possible.
    4. Where any of the information submitted to hackajob by the Candidate contains details that could be used to identify a third party (including, but not limited to, referees), the Candidate must obtain the permission of that party to supply their details to hackajob prior to the Candidate submitting the information to hackajob.
    5. The Services apply Artificial Intelligence in order to match Candidates with Employers. The Artificial Intelligence used does not comprise a “general-purpose AI model as defined in the European Union’s Artificial Intelligence Act - Regulation (EU) 2024/1689, and is specific only to the Services. The Artificial Intelligence will not be used for profiling or automatic decision-making in relation to the use of Personal Data.
    6. As part of the sign-up process, we utilise Artificial Intelligence (AI) technologies to assist in parsing CVs and extracting relevant information to enhance your experience on our platform. All AI data processing is conducted in accordance with our Privacy Policy to ensure your data is handled securely and responsibly.
  5. Applications
    1. When accepting an interview request for a vacancy, the Candidate must ensure that they:
      1. have read the complete details of the vacancy;
      2. understand the requirements of the vacancy;
      3. meet the requirements of the vacancy;
      4. possess any requisite qualifications required by the vacancy; and
      5. have obtained or applied for any relevant permits or authorisations.
    2. When completing forms or any other application documents, the Candidate shall ensure that the details included on the form are to the best of their knowledge, true, accurate, complete, and up-to-date.
    3. The Services will attempt to make a match between Employers and Candidates. Via the Services, the Candidate may receive interview requests from Employers for specific jobs. You can accept or reject such requests via the Services.
  6. How We Use Your Personal Data (Data Protection)
    1. All personal data that hackajob may use will be collected, processed, and held in accordance with the applicable data protection laws, including GDPR, CCPA, India’s DPDP Act, and the Candidate’s rights thereunder.
    2. For complete details of hackajob’s collection, processing, storage, and retention of personal data including, but not limited to, the purpose(s) for which personal data is used, the legal basis or bases for using it, details of the Candidate’s rights and how to exercise them, and personal data sharing (where applicable), please refer to the Privacy Policy.
    3. hackajob may use third-party tools or services, such as analytics or tracking technologies, to enhance the functionality and user experience of the Platform, These services may collect limited data as described in our Privacy policy. By using the Platform, you consent to the use of these integrations and the associated data processing practices.
  7. Acceptable Usage
    1. When using any Services you should do so in accordance with the following rules:
      1. You must not use obscene or vulgar language;
      2. You must not submit Candidate Content that is unlawful or otherwise objectionable. This includes, but is not limited to, Candidate Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;
      3. You must not submit Candidate Content that is intended to promote or incite violence;
      4. Submissions must be made using the English language(s). We will be unable to respond to enquiries submitted in any other languages;
      5. The means by which you identify yourself must not violate these Terms and Conditions or any applicable laws;
      6. You must not impersonate other people, particularly employees and representatives of hackajob or our affiliates; and
      7. You must not submit content that breaches the rights of third parties.
      8. You must adhere to the Code of Conduct at all times and without prejudice to the foregoing, in relation to your interaction with hackajob’s employees and contractors.
    2. You acknowledge that hackajob reserves the right to monitor any and all communications and Candidate Content made to us or using the Services.
    3. You acknowledge that hackajob may retain copies of any and all communications and Candidate Content made to us or using the Services.
    4. You acknowledge that any information you send to us through the Services may be modified by us in any way and you hereby waive your moral right to be identified as the author of such information. Any restrictions you may wish to place upon our use of such information must be communicated to us in advance and we reserve the right to reject such terms and associated information.
    5. You agree that you will be solely responsible for your Candidate Content and for any comments you make anywhere on this Website or tweeted or re-tweeted to or posted on any social media site. Specifically, you agree, represent, and warrant that you have the right to use the Candidate Content that you submit.
    6. You agree that you will be liable to hackajob and will, to the fullest extent permissible by law, indemnify us for any breach of the warranties given by you under sub-Clause 8.1. You will be responsible for any loss or damage suffered by us as a result of such breach.
  8. Liability
    1. hackajob shall not be liable to the Candidate for any of the following:
      1. The loss of any information, data, Candidate Content, CVs, or other materials submitted by the Candidate;
      2. Any errors or inaccuracies present in the information presented to the Candidate including, but not limited to, vacancy advertisements;
      3. The failure of the Candidate to secure employment with any Employer through the Platform whether caused by the negligence of hackajob, its employees, contractors or agents, or any other cause;
      4. The failure of the Candidate to ensure their profile is hidden from their current or previous Employer. The Candidate is responsible for managing the profile’s visibility and privacy settings as necessary.
      5. The actions, decisions, or omissions of Employers, including but not limited to failure to respond to applications, inaccurate job descriptions, or withdrawal of offers. Candidates are advised to independently verify the terms of any employment offer.
      6. Any loss or damage of any kind, howsoever caused arising out of the negligence, misconduct, dishonesty, breach of faith or breach of contract on the part of any Employer; and
      7. Any loss or damage of any kind, howsoever caused arising out of any material submitted to hackajob by the Candidate.
    2. If hackajob is in breach of these Terms and Conditions, it shall only be responsible for any losses to the extent that they are foreseeable to both the Candidate and hackajob as a consequence of such breach.
    3. Notwithstanding, sub-Clause 9.2, hackajob shall not in any event be liable for any business losses such as lost data, lost profits, or business interruption.
    4. Nothing in these Terms and Conditions shall exclude or otherwise restrict hackajob’s liability either for death or personal injury arising out of its own negligence or for fraud. For full details of consumers’ legal rights, including those relating to digital content, please contact your local Citizens’ Advice Bureau or Trading Standards Office.
    5. hackajob exercises all reasonable skill and care to ensure that the Website and Services are free from viruses and other malware. hackajob accepts no liability for any loss or damage resulting from a virus or other malware, a distributed denial of service attack, or other harmful material or event that may adversely affect your hardware, software, data, or other material that occurs as a result of your use of the Website (including the downloading of any content from it) or any other site or Services referred to on the Website.
    6. This Website may contain links to other sites. Unless expressly stated, these sites are not under the control of hackajob or that of our affiliates. We assume no responsibility for the content of such websites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this Website does not imply any endorsement of the sites themselves or of those in control of them.
  9. Indemnity
    The Candidate shall indemnify hackajob against any costs, liability, damages, loss, claims or proceedings incurred or sustained by hackajob which arise out of the Candidate’s use of the Services (including results achieved or unachieved), hackajob’s submission to any Employer of any incorrect or incomplete information provided to hackajob by the Candidate (whether or not that information is required by these Terms and Conditions), or hackajob’s submission to any Employer of any application made by the Candidate for a vacancy where that application contains any incorrect or incomplete information provided to hackajob by the Candidate, or any breach of any of these Terms and Conditions by the Candidate.
  10. Intellectual Property
    1. Material from the Website may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.
    2. Subject to the exceptions in Clause 11.1 of these Terms and Conditions, all Content included on the Website, that is not Candidate Content, including, the Database is the property of hackajob, or our affiliates. By continuing to use the Services you acknowledge that such material is protected by applicable United Kingdom and international intellectual property and other laws.
    3. You may print, reproduce, copy, distribute, store or in any other fashion re-use Content from the Website as specified in Clause 11.1 of these Terms and Conditions and for personal or educational purposes only unless otherwise indicated on the Website or unless given our express written permission to do so. Specifically, you agree that you will not systematically copy Content or third-party candidate Content from the Website with a view to creating or compiling any form of comprehensive collection, compilation, directory or database unless given hackajob’s express written permission to do so.
  11. Force Majeure
    Neither Party shall be liable for any failure or delay in performing any of their obligations hereunder where such failure or delay results from any event, cause or circumstance that is beyond the reasonable control of that Party. Such event, cause or circumstance includes, but is not limited to power failure, Internet Service Provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, epidemic, pandemic (whether naturally occurring or man-made), or other natural physical disaster, acts of terrorism, acts of war, governmental action or any other similar or dissimilar event that is beyond the control of the Party in question.
  12. Notices
    1. All notices under these Terms and Conditions shall be in writing and be deemed duly given if signed by, or on behalf of, a duly authorised officer of hackajob or by the Candidate
    2. Notices shall be deemed to have been duly given:
      1. when delivered, if delivered by courier or other messenger (including registered mail) during the normal business hours of the recipient; or
      2. when sent, if transmitted by e-mail and a successful return receipt is generated; or
      3. on the fifth business day following mailing, if mailed by national ordinary first class mail, postage prepaid.
    3. All notices of these Terms and Conditions shall be addressed to the most recent address or e-mail address notified to the other Party.
  13. Relationship of Parties
    Nothing in these Terms and Conditions shall create, or be deemed to create, a partnership, the relationship of principal and agent, or of employer and employee between hackajob and the Candidate.
  14. Third Parties
    Nothing in these Terms and Conditions shall confer any benefit on or be enforceable by any party that is not a party to these Terms and Conditions under the Contracts (Rights of Third Parties) Act 1999.
  15. Severance
    In the event that one or more of the provisions of these Terms and Conditions is found to be unlawful, invalid, or otherwise unenforceable, that / those provisions shall be deemed severed from the remainder of these Terms and Conditions. The remainder of these Terms and Conditions shall be valid and enforceable.
  16. Modification and Entire Agreement
    1. hackajob may update these Terms and Conditions as needed. Changes will be posted on the Website, and your continued use of the Services constitutes acceptance of the updated Terms.
    2. If the Candidate does not agree to be bound by any modified terms and conditions hackajob introduces, the Candidate must immediately cease using the Services upon publication of those modified terms and conditions.
    3. These Terms and Conditions as modified in accordance with Clause 17 shall represent the entire agreement between the Candidate and hackajob, and it supersedes all previous agreements, terms, conditions, representations, or claims which may have been made or agreed upon between them.
  17. Digital Content
    1. When providing digital content to consumers, we are required to provide digital content that is of satisfactory quality, fit for any purpose made known to us (whether expressly or impliedly) and in accordance with any descriptions (and pre-contract information) given by us. This includes any digital content we may subsequently modify. If we fail to comply with our legal obligations, consumers may be entitled to certain legal remedies. For full details of consumers’ legal rights, including those relating to digital content, please contact your local Citizens Advice Bureau or Trading Standards Office.
  18. Law and Jurisdiction
    1. The contract between the Parties, their subject matter and its formation are governed by the Laws of England and Wales. The Parties agree that the courts of England and Wales will have exclusive jurisdiction except that if the Candidate is a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland. If the Candidate is a resident of the United States, you may also bring proceedings in the appropriate courts of the United States; and if the Candidate is a resident of India, you may also bring proceedings in the appropriate courts of India. If you reside outside of the regions listed above, these Terms are governed by the laws of England and Wales, with disputes resolved in the courts of England and Wales.
